Canvas Forge — Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between Canvas Forge, a sole proprietorship owned by Sam Cohen("Canvas Forge," "we," "us," or "our"), and you ("you" or "User"). These Terms govern your access to and use of canvasforge.com and related services, including AI-assisted image generation, product mockups, and custom merchandise production and shipping via third-party fulfillment partners (collectively, the "Services"). By creating an account, using preview generation, or placing an order, you agree to these Terms.

1. Eligibility & Accounts

Previews: You must be at least 13 years old to use preview generations (no uploads).
Accounts & Purchases: You must be at least 18 to create an account and to purchase products.
You are responsible for your account credentials and all activity under your account.
We may refuse, suspend, or terminate access for any reason, including suspected policy violations or abuse.

2. "Try Without Signing In" — Preview Generations

Landing page allows up to two (2) AI preview generations without sign-in. Uploads are not allowed in preview mode.
We may store preview prompts/outputs and basic device/IP metadata to prevent abuse and improve quality. Storage may be temporary or indefinite (see Privacy Policy for details and deletion options).
Preview outputs are for evaluation only — no commercial rights are granted unless you create an account and complete a purchase.

3. User Content & Licenses

"User Content" includes prompts, text, images, designs, and uploads (uploads are for signed-in users only). You represent and warrant that you own or have necessary rights to your User Content; that it does not infringe or violate any rights or law; and that it complies with our Acceptable Use / Content Policy.

License to operate the Services. You grant Canvas Forge a non-exclusive, worldwide, royalty-free license to host, process, reproduce, modify, and display your User Content and resulting images solely to provide and improve the Services (e.g., generate, mock up, print, ship, support).

Optional marketing license. We will only showcase your finished designs/products publicly if you explicitly opt in. You can revoke prospectively at any time.

4. AI Tools & Outputs

AI outputs may be inaccurate, biased, or unsuitable. Review carefully before ordering.
Do not attempt to generate illegal, infringing, or harmful content.
Unless otherwise stated at checkout, you own the final generated artwork to the extent permitted by law and subject to third-party rights in your prompts/uploads. You grant us the limited license above to fulfill your orders.
We may apply automated/manual moderation and refuse or remove content at our discretion.

5. Acceptable Use / Content Rules

You agree not to use the Services to:

Break the law or encourage illegal conduct; create sexual content involving minors; explicit sexual content; instructions for violent/illegal activities; self-harm content.
Promote hate or violence against protected classes or individuals; harass, dox, or threaten others.
Infringe IP or publicity/privacy rights (e.g., unlicensed logos, celebrity likenesses without permission, copyrighted characters).
Deceive or defraud; present professional advice (medical/financial/legal) as authoritative outputs.
Circumvent safety filters, spam, rate limits; reverse engineer; scrape without permission.
Upload malware or interfere with the operation or security of our Services or partners.
Automate access except via documented APIs with our written permission.

6. Ordering, Pricing, Taxes & Payment

You authorize us and our payment processor (e.g., Stripe) to charge order amount, shipping, taxes, and duties where applicable.
Prices may change at any time before checkout. Applicable taxes/duties depend on destination and law.

7. Production, Fulfillment & Shipping

We use third-party manufacturing and shipping partners. Production/delivery times are estimates.
Risk of loss passes to you when handed to the carrier. Use tracked shipping where available.
We are not liable for delays outside our reasonable control (e.g., supply chain, weather, customs, carriers).

8. Custom Goods — Cancellations, Returns & Replacements

Made-to-order: All items are custom printed for you and are final sale once production begins.
Cancellations: Orders may be cancelled on a best-effort basis only if production has not started. Once in production, cancellations are not possible.
No returns for buyer’s remorse: We do not accept returns or exchanges for reasons such as dislike, wrong size, or changed mind.
Defects/Damage: If an item arrives misprinted, damaged, or materially defective, we will replace it or refund you. Contact us within 30 days of delivery at support@canvasforge.com with your order number and clear photos.
Normal variation: Minor differences in color, placement, or cropping are inherent to on-demand printing and are not defects.

9. Intellectual Property

The Services, site content, software, and trademarks are owned by Canvas Forge or its licensors and protected by law. Except for your User Content and generated images (as assigned to you above), you receive no rights in our IP.

10. Third-Party Services

We integrate payment, manufacturing, shipping, analytics, and AI providers. Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services.

11. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Canvas Forge AND ITS OWNERS/EMPLOYEES/PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE 6 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You will defend, indemnify, and hold harmless Canvas Forge from any claim, loss, and expense (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or law.

14. Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time, including for policy violations. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, governing law) survive termination.

15. Governing Law & Venue; Class Action Waiver

These Terms are governed by the laws of the State of New York, excluding its conflicts of law rules. The exclusive venue is in New York, New York, USA, and you consent to personal jurisdiction there. Disputes must be brought in your or our individual capacity (no class or representative actions).

16. Changes to Services or Terms

We may modify the Services and these Terms. We will post changes and update the "Last updated" date. Changes apply prospectively. Continued use after changes take effect constitutes acceptance.

17. DMCA / Copyright Complaints

If you believe content infringes your copyright, email support@canvasforge.com with: (a) your contact info; (b) a description/URL of the material; (c) a statement under penalty of perjury that you have a good-faith belief the use is not authorized; (d) a statement that the information is accurate and you are the owner/agent; and (e) your electronic signature. We may remove content and terminate repeat infringers.

18. Miscellaneous

If a provision is unenforceable, the rest remain in effect. No waiver is a continuing waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. These Terms constitute the entire agreement regarding the Services.
